SECTION 1. SHORT TITLE.

This Act may be cited as the “Stop Higher Education Espionage and Theft Act of 2018”.

SEC. 2. DESIGNATION OF FOREIGN INTELLIGENCE THREATS TO HIGHER EDUCATION.

(a) In General.—Chapter 33 of title 28, United States Code, is amended by adding at the end the following:

"540D. 指定外国情报对高等教育的威胁

"(a)定义. ー在本节ー

“(a) Definitions.—In this section—

"(1)'机密信息'一词的含义与《机密信息程序法》(《美利坚合众国法典》第18编第(a)节所规定的术语含义相同 ;

“(1) the term ‘classified information’ has the meaning given that term in section 1(a) of the Classified Information Procedures Act (18 U.S.C. App.);

"(2)'局长'一词是指联邦调查局局长,经与司法部长、教育部长和国家情报局局长协商后行事;

“(2) the term ‘Director’ means the Director of the Federal Bureau of Investigation, acting in consultation with the Attorney General, Secretary of Education, and the Director of National Intelligence;

"(3)'外国演员'一词是指ーー

“(3) the term ‘foreign actor’ means—

"(a)外国政府或其附属领土,或其任何组成部分,不论是否得到美国承认;

“(A) a foreign government or its auxiliary territories, or any component thereof, whether or not recognized by the United States;

“(B) a foreign-based political organization, not substantially composed of United States persons;

“(C) a faction of a foreign nation or nations, not substantially composed of United States persons;

“(D) an entity that is openly acknowledged by a foreign government or governments to be directed and controlled by such foreign government or governments;

“(E) any partnership, association, corporation, organization, or other combination of persons who acts as an agent, representative, employee, or servant of, or whose activities are directly or indirectly supervised, directed, controlled, financed, or subsidized in whole or in major part by a government, organization, faction, or entity described in subparagraph (A), (B), (C), or (D); or

"(f)任何个人,作为(a)、(b)、(c)或(d)项所述的政府、组织、派别或实体的代理人、代表、雇员或仆人,或其活动全部或主要由该政府、组织、派别或实体直接或间接监督、指示、控制、资助或补贴,除非该个人是美国公民并在美国定居;

“(F) any individual who acts as an agent, representative, employee, or servant of, or whose activities are directly or indirectly supervised, directed, controlled, financed, or subsidized in whole or in major part by a government, organization, faction, or entity described in subparagraph (A), (B), (C), or (D), unless such individual is a citizen of and domiciled within the United States;

(4)"机构"一词系指《高等教育法》第101条(《美利坚合众国法典》第20编第1001节)所界定的任何高等教育机构;

“(4) the term ‘institution’ means any institution of higher education, as defined under section 101 of the Higher Education Act (20 U.S.C. 1001);

(五)"国家安全"一词系指美国的国防、对外关系或者经济利益;

“(5) the term ‘national security’ means the national defense, foreign relations, or economic interests of the United States;

"(6)'国会有关委员会'一词是指ーー

“(6) the term ‘relevant committees of Congress’ means—

"(a)司法委员会、情报特别委员会、国土安全和政府事务委员会以及参议院卫生、教育、劳工和养老金委员会;

“(A) the Committee on the Judiciary, the Select Committee on Intelligence, the Committee on Homeland Security and Government Affairs, and the Committee on Health, Education, Labor, and Pensions of the Senate; and

"(b)司法委员会、常设情报特别委员会、国土安全委员会和众议院教育和劳动力委员会;以及

“(B) the Committee on the Judiciary, the Permanent Select Committee on Intelligence, the Committee on Homeland Security, and the Committee on Education and the Workforce of the House of Representatives; and

"(7)'美国人'一词的含义与1978年《外国情报监视法》(《美利坚合众国法典》第50编第1801节)第101节所规定的含义相同。

“(7) the term ‘United States person’ has the meaning given that term in section 101 of the Foreign Intelligence Surveillance Act of 1978 (50 U.S.C. 1801).

"(b)设计ー

“(b) Designation.—

"(1)第(1)条第(1)款ー如果主任认定某一外国行为者已经、企图或共谋犯下下列一项或多项与某一机构有关的行为,则主任应根据本款指定该外国行为者为对高等教育构成威胁的外国情报行为者:

“(1) IN GENERAL.—The Director shall designate a foreign actor as a foreign intelligence threat to higher education, in accordance with this subsection, if the Director finds that the foreign actor has committed, attempted to commit, or conspired to commit, in connection with an institution, one or more of the following:

"(a)间谍活动,违反第18编第791至799节。

“(A) Espionage, in violation of sections 791 through 799 of title 18.

"(b)绑架,违反第18编第1201节。

“(B) Kidnapping, in violation of section 1201 of title 18.

"(c)违反第18编第1546节,欺诈或滥用签证、许可证或其他文件。

“(C) Fraud or misuse of visas, permits, or other documents, in violation of section 1546 of title 18.

"(d)严重盗窃身份,违反第18条第1028A 款。

“(D) Aggravated identity theft, in violation of section 1028A of title 18.

"(e)与接入设备有关的欺诈或相关活动,违反第18编第1029节。

“(E) Fraud or related activity in connection with access devices, in violation of section 1029 of title 18.

"(f)与计算机有关的欺诈或相关活动,违反第18编第1030节。

“(F) Fraud or related activity in connection with computers, in violation of section 1030 of title 18.

"(g)经济间谍活动,违反第18编第1831节。

“(G) Economic espionage, in violation of section 1831 of title 18.

“(H) Theft of trade secrets, in violation of section 1832 of title 18.

“(I) Terrorism, in violation of sections 2331 through 2339D of title 18.

“(J) Interception or disclosure of wire, oral, or electronic communications, in violation of section 2511 of title 18.

"(2)程序ー

“(2) PROCEDURE.—

"(a)指定前的通知ー

“(A) NOTICE BEFORE DESIGNATION.—

"(i)致国会领导人ーー在根据本款作出指定前不迟于7天,该主任应向众议院议长和少数党领袖、美国参议院临时议长、参议院多数党领袖和少数党领袖以及国会有关委员会的成员提交报告

“(i) TO CONGRESSIONAL LEADERS.—Not later than 7 days before making a designation under this subsection, the Director shall submit to the Speaker and Minority Leader of the House of Representatives, the President pro tempore, Majority Leader, and Minority Leader of the Senate, and the members of the relevant committees of Congress—

"(i)局长打算根据本款指定外国演员的书面通知;以及

“(I) written notice of the intent of the Director to designate a foreign actor under this subsection; and

"(二)根据第(1)款对外国行为者所作的调查结果及其事实依据。

“(II) the findings made under paragraph (1) with respect to foreign actor and the factual basis therefor.

"(二)向总检察长ーー在根据本款作出指定之前不迟于7天,局长应向总检察长提交报告,由总检察长决定是否需要进一步调查或起诉ーー

“(ii) TO THE ATTORNEY GENERAL.—Not later than 7 days before making a designation under this subsection, the Director shall submit to the Attorney General, for the Attorney General to determine whether further investigation or prosecution is warranted—

"(i)局长打算根据本款指定外国演员的书面通知;以及

“(I) written notice of the intent of the Director to designate a foreign actor under this subsection; and

"(二)根据第(1)款对外国行为者所作的调查结果及其事实依据。

“(II) the findings made under paragraph (1) with respect to the foreign actor and the factual basis therefor.

"(iii)保护机密信息ー根据第(i)和(ii)条提交的通知和调查结果可采用机密形式。

“(iii) PROTECTION OF CLASSIFIED INFORMATION.—The notice and findings submitted under clauses (i) and (ii) may be in classified form.

"(b)在联邦登记处公布ーー如果董事根据本款作出指定,董事应在指定之日在联邦登记处公布该项指定。

“(B) PUBLICATION IN FEDERAL REGISTER.—If the Director makes a designation under this subsection, the Director shall publish the designation in the Federal Register on the date of the designation.

"(c)指定的效力ーー为了1965年《高等教育法》第117条(《美利坚合众国法典》第20编第1011f 节)的目的,本条规定的指定自根据(b)项公布之日起生效。

“(C) EFFECT OF DESIGNATION.—For purposes of section 117 of the Higher Education Act of 1965 (20 U.S.C. 1011f), a designation under this subsection shall take effect upon publication under subparagraph (B).

"(3)记录ー

“(3) RECORD.—

"(a)总则ーー董事根据本款作出指定时,应当建立行政记录。

“(A) IN GENERAL.—In making a designation under this subsection, the Director shall create an administrative record.

"(b)机密信息ー处长在根据本款作出指定时,可以考虑机密信息。机密信息在仍属机密期间不得予以披露,但为根据第(d)款进行司法审查的目的,此类信息可单方面和不公开地向法院披露。

“(B) CLASSIFIED INFORMATION.—The Director may consider classified information in making a designation under this subsection. Classified information shall not be subject to disclosure for such time as it remains classified, except that such information may be disclosed to a court ex parte and in camera for purposes of judicial review under subsection (d).

"(4)指定期限ー

“(4) PERIOD OF DESIGNATION.—

"(a)在第一般条款中ー本款下的指定,在根据第(5)款或第(6)款撤销或根据第(d)款撤销之前,为一切目的而有效。

“(A) IN GENERAL.—A designation under this subsection shall be effective for all purposes until revoked under paragraph (5) or (6) or set aside under subsection (d).

"(b)请愿书上的名称审查ー

“(B) REVIEW OF DESIGNATION UPON PETITION.—

"(i)第一类ー如果被指认的外国行为者在第(ii)条所述的申请期限内提出撤销申请,主任应根据第(iii)和(iv)条规定的程序,审查对高等教育构成外国情报威胁的指认。

“(i) IN GENERAL.—The Director shall review the designation of a foreign intelligence threat to higher education under the procedures set forth in clauses (iii) and (iv) if the designated foreign actor files a petition for revocation within the petition period described in clause (ii).

"(ii)请愿的期限ーー为了第(i)条的目的ーー

“(ii) PETITION PERIOD.—For purposes of clause (i)—

"(i)如果被指认的外国行为者以前没有根据本项提出撤销申请,申请期从指认之日起2年开始;或

“(I) if the designated foreign actor has not previously filed a petition for revocation under this subparagraph, the petition period begins 2 years after the date on which the designation was made; or

"(二)如果被指认的外国行为者事先根据本分段提出了撤销请愿,请愿期限自根据第(四)款就该请愿作出裁定之日起2年。

“(II) if the designated foreign actor has previously filed a petition for revocation under this subparagraph, the petition period begins 2 years after the date of the determination made under clause (iv) with respect to that petition.

"(三)程序ー任何被指定为对高等教育构成外国情报威胁的外国行为者,如根据本项提出撤销申请,应在申请书中提供证据,证明第(1)款所述的有关情况与作为指定依据的情况有很大不同,因此有理由撤销对该外国行为者的指定。

“(iii) PROCEDURES.—Any foreign actor designated as a foreign intelligence threat to higher education that submits a petition for revocation under this subparagraph shall provide evidence in the petition that the relevant circumstances described in paragraph (1) are sufficiently different from the circumstances that were the basis for the designation such that a revocation with respect to the foreign actor is warranted.

(iv)鉴定ー

“(iv) DETERMINATION.—

"(i)第一类:在收到根据本分段提交的撤销申请后180天内,署长应就撤销申请作出决定。

“(I) IN GENERAL.—Not later than 180 days after receiving a petition for revocation submitted under this subparagraph, the Director shall make a determination as to such revocation.

(II)机密资料ー署长在就撤销呈请作出决定时,可考虑机密资料。机密信息在仍属机密期间不得予以披露,但为根据第(d)款进行司法审查的目的,此类信息可单方面和不公开地向法院披露。

“(II) CLASSIFIED INFORMATION.—The Director may consider classified information in making a determination in response to a petition for revocation. Classified information shall not be subject to disclosure for such time as it remains classified, except that such information may be disclosed to a court ex parte and in camera for purposes of judicial review under subsection (d).

"(III)公布决定ーー董事根据本条款作出的决定应在联邦登记册上公布。

“(III) PUBLICATION OF DETERMINATION.—A determination made by the Director under this clause shall be published in the Federal Register.

(IV)程序ー署长撤销指定的任何行动,须按照第(6)款的规定进行。

“(IV) PROCEDURES.—Any revocation of a designation by the Director shall be made in accordance with paragraph (6).

"(c)对指定的其他审查ー

“(C) OTHER REVIEW OF DESIGNATION.—

"(i)第一类:如果在任何5年期间没有根据(b)项进行审查,主任应审查将外国行为者指定为对高等教育构成威胁的外国情报机构,以确定是否应根据第(6)款撤销这种指定。

“(i) IN GENERAL.—If no review has taken place under subparagraph (B) during any 5-year period, the Director shall review the designation of a foreign actor as a foreign intelligence threat to higher education in order to determine whether such designation should be revoked pursuant to paragraph (6).

"(ii)程序ー如果没有根据(b)项对根据该项提出的撤销申请进行审查,则应按照署长制定的程序进行审查。这种审查的结果和适用的程序不应在任何法院复审。

“(ii) PROCEDURES.—If a review does not take place pursuant to subparagraph (B) in response to a petition for revocation that is filed in accordance with that subparagraph, the review shall be conducted pursuant to procedures established by the Director. The results of such review and the applicable procedures shall not be reviewable in any court.

"(iii)公布审查结果ー主任应在联邦登记册上公布根据本项作出的任何决定。

“(iii) PUBLICATION OF RESULTS OF REVIEW.—The Director shall publish any determination made under this subparagraph in the Federal Register.

(五)国会法令撤销ーー国会法令可以阻止或者撤销根据第(1)款作出的指定。

“(5) REVOCATION BY ACT OF CONGRESS.—Congress, by an Act of Congress, may block or revoke a designation made under paragraph (1).

"(6)基于环境变化的撤销ー

“(6) REVOCATION BASED ON CHANGE IN CIRCUMSTANCES.—

"(a)在第(1)款中——如果局长认为ーー,可随时撤销根据第(1)款作出的指定,并应在根据第(4)款第(b)和(c)项进行的审查完成后撤销指定

“(A) IN GENERAL.—The Director may revoke a designation made under paragraph (1) at any time, and shall revoke a designation upon completion of a review conducted pursuant to subparagraphs (B) and (C) of paragraph (4) if the Director finds that—

"(i)作为指定依据的情况发生变化,以致需要撤销指定;或

“(i) the circumstances that were the basis for the designation have changed in such a manner as to warrant revocation; or

"(ii)美国的国家安全有权撤销。

“(ii) the national security of the United States warrants a revocation.

"(b)程序ー第(2)款和第(3)款的程序要求适用于根据本款规定撤销。如果没有指明生效日期,任何撤销将在撤销指明的日期生效,或在联邦登记册上公布。

“(B) PROCEDURE.—The procedural requirements of paragraphs (2) and (3) shall apply to a revocation under this paragraph. Any revocation shall take effect on the date specified in the revocation or upon publication in the Federal Register if no effective date is specified.

"(7)撤销的效力ー根据第(5)款或第(6)款撤销指定,不影响基于在撤销生效之日前所实施的行为而采取的任何行动或进行的任何程序。

“(7) EFFECT OF REVOCATION.—The revocation of a designation under paragraph (5) or (6) shall not affect any action or proceeding based on conduct committed prior to the effective date of such revocation.

"(c)对一项指定的修正ー

“(c) Amendments To A Designation.—

"(1)第(1)款ーー如果局长发现外国行为者更改了其名称、采用了新的别名、解散并随后以不同的名称重组,或者与另一外国行为者合并,局长可以修改第(2)款下的指定。

“(1) IN GENERAL.—The Director may amend a designation under subsection (b) if the Director finds that the foreign actor has changed its name, adopted a new alias, dissolved and then reconstituted itself under a different name or names, or merged with another foreign actor.

"(2)程序ー根据第(1)款对指定作出的修改,在联邦登记册上公布后即生效。第(b)(2)款第(b)项及第(c)项适用于经修订的指定。第(b)款第(2)(a)(i)、(4)、(5)、(6)、(7)及(8)款亦适用于经修订的指定。

“(2) PROCEDURE.—Amendments made to a designation in accordance with paragraph (1) shall be effective upon publication in the Federal Register. Subparagraphs (B) and (C) of subsection (b)(2) shall apply to an amended designation upon such publication. Paragraphs (2)(A)(i), (4), (5), (6), (7), and (8) of subsection (b) shall also apply to an amended designation.

“(3) ADMINISTRATIVE RECORD.—The administrative record shall be corrected to include the amendments as well as any additional relevant information that supports those amendments.

"(4)机密信息ー署长在根据本款修改指定内容时,可以考虑机密信息。机密信息在仍属机密期间不得予以披露,但为根据第(d)款进行司法审查的目的,此类信息可单方面和不公开地向法院披露。

“(4) CLASSIFIED INFORMATION.—The Director may consider classified information in amending a designation in accordance with this subsection. Classified information shall not be subject to disclosure for such time as it remains classified, except that such information may be disclosed to a court ex parte and in camera for purposes of judicial review under subsection (d).

"(d)对指定的司法审查ー

“(d) Judicial Review Of Designation.—

"(1)在普通高等教育中,被指定为外国情报威胁的外国行为者,在《联邦登记册》公布指定、修正指定或对撤销请求作出裁定后30天内,可向美国哥伦比亚特区巡回上诉法院寻求司法复审。

“(1) IN GENERAL.—Not later than 30 days after publication in the Federal Register of a designation, an amended designation, or a determination in response to a petition for revocation, the foreign actor designated as a foreign intelligence threat to higher education may seek judicial review in the United States Court of Appeals for the District of Columbia Circuit.

"(2)审查的依据ーー根据本款进行的审查仅以行政记录为依据,但政府可以依据《机密信息程序法》(《美利坚合众国法典》第18编第2节)的规定,以单方面和非公开审查的方式,提交用于指定、修改指定或对撤销请愿作出决定的机密信息 .

“(2) BASIS OF REVIEW.—Review under this subsection shall be based solely upon the administrative record, except that the Government may submit, for ex parte and in camera review, classified information used in making the designation, amended designation, or determination in response to a petition for revocation, in a manner consistent with the Classified Information Procedures Act (18 U.S.C. App.).

"(3)审查范围ーー法院认为指定、修改指定或对法院认为是ーー的撤销指定、修改指定或裁定是不合法的

“(3) SCOPE OF REVIEW.—The Court shall hold unlawful and set aside a designation, amended designation, or determination in response to a petition for revocation the court finds to be—

"(a)任意的、反复无常的、滥用自由裁量权的,或者不符合法律的;

“(A) arbitrary, capricious, an abuse of discretion, or otherwise not in accordance with law;

(b)违反宪法规定的权利、权力、特权或豁免权;

“(B) contrary to constitutional right, power, privilege, or immunity;

(c)超越法定管辖权、权限或者时效,或者缺乏法定权利;

“(C) in excess of statutory jurisdiction, authority, or limitation, or short of statutory right;

(d)整个行政记录或根据第(2)款提交法院的机密资料缺乏实质性支持;或

“(D) lacking substantial support in the administrative record taken as a whole or in classified information submitted to the court under paragraph (2); or

"(e)不符合法律规定的程序。

“(E) not in accord with the procedures required by law.

"(4)司法审查 invoiced. ー对指定、经修改的指定或对撤销请求作出的裁定进行司法审查的诉讼待决,不影响本节的适用,除非法院针对撤销请求发布最后命令,撤销指定、经修改的指定或裁定。

“(4) JUDICIAL REVIEW INVOKED.—The pendency of an action for judicial review of a designation, amended designation, or determination in response to a petition for revocation shall not affect the application of this section, unless the court issues a final order setting aside the designation, amended designation, or determination in response to a petition for revocation.

"(e)报告书ー

“(e) Reports.—

"(1)总则ーー在不迟于本节制定之日后180天及其后每年,局长应向国会有关委员会提交一份详细报告,其中载有下列内容:

“(1) IN GENERAL.—Not later than 180 days after the date of enactment of this section, and every year thereafter, the Director shall submit to the relevant committees of Congress a detailed report containing the following:

"(a)对从事第(b)(1)款所列活动的外国行为者的描述和评估。

“(A) A description and assessment of foreign actors who engage in activities listed in subsection (b)(1).

"(b)评估从事第(b)(1)款所列活动的外国行为者对有关机构的学术和研究与发展的影响。

“(B) An assessment of the impact of foreign actors who engage in activities listed in subsection (b)(1) on scholarship and research and development in connection with institutions.

"(c)评估本节规定的外国情报对高等教育的威胁指认程序的执行情况和运作情况。

“(C) An assessment of the implementation and operation of the designation process for foreign intelligence threats to higher education established under this section.

"(d)评估指定外国情报对高等教育的威胁对第(b)(1)款所列与机构有关的活动的可能影响。

“(D) An assessment of the likely effects of the designation of foreign intelligence threats to higher education on activities listed in subsection (b)(1) in connection with institutions.

(2)报告格式ーー第(1)款规定的报告应以非保密格式提交,但可附加保密附件 .

“(2) FORM OF REPORTS.—The reports required under paragraph (1) shall be submitted in an unclassified form, but may contain a classified annex.”.

(b)技术性和一致性修正ー对《美利坚合众国法典》第28编第33章章节表进行修正,在末尾增加以下内容:

(b) Technical And Conforming Amendment.—The table of sections for chapter 33 of title 28, United States Code, is amended by adding at the end the following:

SEC. 3. DISCLOSURE OF FOREIGN GIFTS OR CONTRACTS.

对1965年《高等教育法》第117条(《美国法典》第20编第1011f 节)进行了修正ー

Section 117 of the Higher Education Act of 1965 (20 U.S.C. 1011f) is amended—

(1)删除第(a)款,并加入以下内容:

(1) by striking subsection (a) and inserting the following:

"(a)披露报告ー

“(a) Disclosure Report.—

"(1)第(2)款所述机构在一历年内,须于1月31日或7月31日前,根据第(b)款向局长提交披露报告,以较早者为准。

“(1) IN GENERAL.—An institution described in paragraph (2) for a calendar year shall file a disclosure report under subsection (b) with the Secretary by January 31 or July 31, whichever is sooner.

"(2)机构类型ーー本段所述的机构是ーー

“(2) TYPES OF INSTITUTIONS.—An institution described in this paragraph is an institution that—

"(a)由外国资源拥有或控制;

“(A) is owned or controlled by a foreign source;

"(b)在一个日历年内,单独或与外国来源的所有其他礼物或与该外国来源的合同一并考虑,从该外国来源接受礼物或与该外国来源订立合同,其价值为25万美元或以上;或

“(B) receives a gift from or enters into a contract with a foreign source, the value of which is $250,000 or more, considered alone or in combination with all other gifts from or contracts with that foreign source within a calendar year; or

(2) in subsection (b)—

(A) by redesignating paragraphs (1) through (3) as subparagraphs (A) through (C), respectively, and adjusting the margins appropriately;

“(2) REQUIREMENTS RELATING TO FOREIGN INTELLIGENCE THREATS.—For any institution described in subsection (a)(2)(C), the report required under this section shall contain, in addition to any applicable information required under paragraph (1)—

“(A) the identity of the foreign intelligence threat to higher education involved; and

“(B) the aggregate dollar amount of such gifts and contracts attributable to the foreign intelligence threat to higher education, as measured by the fair market value of such gifts and contracts.”;

(4) in subsection (e), by inserting “, and shall also be accessible to the public through electronic means” before the period at the end; and

第(5)款(h)ー

(5) in subsection (h)—

(a)重新指定第(2)至(5)段分别为第(3)至(6)段;

(A) by redesignating paragraphs (2) through (5) as paragraphs (3) through (6), respectively;

(b)在第(1)款之后加入以下内容:

(B) by inserting after paragraph (1) the following:

"(2)'对高等教育的外国情报威胁'一词系指根据《美国法典》第28编第540D 节被指定为对高等教育构成威胁的任何外国情报来源;";

“(2) the term ‘foreign intelligence threat to higher education’ means any foreign source that is designated as a foreign intelligence threat to higher education in accordance with section 540D of title 28, United States Code;”;

(C) in paragraph (4) (as so redesignated), by striking “or property” and inserting “, property, services, or payment to the staff of an institution”;

(D) by striking paragraph (5) (as so redesignated) and inserting the following:

"(5)'机构'一词系指高等教育机构ー

“(5) the term ‘institution’ means an institution of higher education—

“(A) to which Federal financial assistance is extended (directly or indirectly through another entity or person); or

"(b)接受联邦财政援助向机构的任何下属单位提供的支助";和

“(B) that receives support from the extension of Federal financial assistance to any of the institution's subunits”; and

(e)在第(6)(b)段(如此重新定义) ,在"研究或讲座"之前插入"研究所、教学计划"。

(E) in paragraph (6)(B) (as so redesignated), by inserting “institutes, instructional programs,” before “research or lecture”.
